1. Agreement to Terms

By accessing or using VyralForge ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

VyralForge is a browser-based platform that allows users to create short-form video content through interactive mini-games. Users can customize games, record gameplay, and export videos for social media platforms.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account
  • Be at least 13 years old (or the minimum age in your jurisdiction)

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Payments

4.1 Pricing

We offer various subscription plans with different features. Prices are displayed on our website and may change with notice. All prices are in USD unless otherwise stated.

4.2 Billing

Subscriptions are billed in advance on a monthly or yearly basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Free Trial

New users may be eligible for a free trial. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods.

5. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload or share illegal, harmful, or offensive content
  • Harass, abuse, or harm others
  • Distribute malware or engage in hacking
  • Circumvent or manipulate our billing systems
  • Create content that promotes hate, violence, or discrimination
  • Impersonate others or misrepresent your affiliation
  • Use automated systems to access the Service without permission
  • Interfere with or disrupt the Service or servers

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you create using our Service (names, images you upload, exported videos). By uploading content, you grant us a non-exclusive license to use, store, and process it for providing the Service.

6.2 Our Content

The Service, including its games, design, code, and features, is owned by VyralForge and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

6.3 User-Generated Videos

Videos you create and export are yours to use, including for commercial purposes on social media platforms. You are solely responsible for ensuring your content does not infringe on third-party rights.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYRALFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

9. Indemnification

You agree to indemnify and hold harmless VyralForge, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive (including ownership, disclaimers, and limitations of liability).

11. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts in the applicable jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VyralForge regarding the Service and supersede all prior agreements.
